Terms of Service (the “Terms”) for London Bath Property Ltd

These Terms are important as they, set out the legal terms of our Service to provide Accomodation. They also cover any interactions or communications you have with us through our Service. Your use of our Service is conditioned upon your acceptance of these Terms. When you make a booking, you must also accept these Terms. If you do not accept these Terms, then please do not use our Service or make a booking.

We may change these Terms at any time and your future use of our Service following changes to these Terms is subject to you accepting those updated Terms. We recommend that you save or print a copy of these Terms.

In these Terms:

“we”, “us” or “our” refer to London Bath Property Ltd registered at 17 Trossachs Drive, Bath, BA2 6RP.
“our Partners” refers to any affiliated, or linked website through which London Bath Property Ltd provides content or service.
“our Service” refers to the provision of our websites, apps and online tools.
“A booking” refers to an accepted booked accommodation.
“you” refers to you, the traveller, using our Service or making a booking with our Service.
“Accommodation” refers to a short stay holiday letting.

Please read these Terms carefully.

Section 1 – Rules and Restrictions

As well as these Terms, other terms and conditions provided by Online Providers, a property’s terms and conditions, also apply to your booking (“Rules and Restrictions”).

To make a booking, you must accept the Rules and Restrictions of the accommodation portal that you select (such as payment of due amounts, refundability, penalties, availability restrictions and use of fares or services, etc.). The relevant Rules and Restrictions are provided to you before you make a booking and are incorporated by reference into these Terms.

If you violate Rules and Restrictions, your booking may be cancelled and you may be denied access to the relevant accommodation. You may also lose any money paid for such
booking and we or the booking portal may debit your account for any costs we or they incur as a result of such violation.

Accomodation Providers may either be individuals acting on a consumer to consumer basis, or professionals operating on a business to consumer basis. If you enter into an agreement with an individual on a consumer-to-consumer basis, please be aware that consumer law will not apply in relation to your contract with the booking portal. The Accommodation Provider is solely responsible for determining whether or not they are operating as a consumer or a business and for any representations they make to you with
respect to their status.

Section 2 – Using our Service

Our rules

We provide our Service to help you find accommodation and assist you in booking that accommodation. It is provided to you for no other purpose.
You will only use our Service for personal and non-commercial purposes.
You must be at least 18 years of age and have the legal authority to enter into contracts.
You will use our Service lawfully and in compliance with these terms.
All information supplied by you is true, accurate, current and complete.

If you book on behalf of others:

You will obtain their authorisation prior to acting on their behalf.
You will inform them about the terms that apply to the booking (including the Rules and Restrictions) and ensure that they agree to such terms.
You are responsible for paying any amounts due, for making any change/cancellation requests and for all other matters relating to the booking.

You also agree not to:

Make any false or fraudulent booking.
Access, monitor or copy any content on our Service using any robot, spider, scraper or other automated means or any manual process.
Take any action that imposes, or may impose, an unreasonable or large load on our infrastructure.
Deep link to any part of our Service.
“Frame”, “Mirror” or otherwise incorporate any part of our Service into any other website.

Access

We may deny anyone access to our Service at any time for any valid reason. We may also make improvements and changes to our Service at any time.

Section 3 – Confirming a booking

Your Booking Confirmation includes the essential elements of your booking, such as the description of the booked accommodation and the price.

We will send your Booking Confirmation to the email address you provide.

Section 4 – Payment

Price

The price of the accommodation will be as displayed before you book, except in cases of obvious error.
Prices for accommodation are dynamic and can change at any time. Price changes will not affect bookings already accepted, except in cases of obvious error.
If there is an obvious error and you have made a booking, we will offer you the opportunity to keep your booking by paying the correct price or we will cancel your booking without penalty. We have no obligation to make available accommodation to you at an incorrect (lower) price even after you have been sent a Booking Confirmation, if the error should reasonably have been apparent to you.

Taxes

The prices displayed through our Service may include taxes or tax recovery charges. Such taxes or tax recovery charges may include amounts associated with value-added tax, goods and services tax, sales tax, occupancy tax and other taxes of a similar nature.
In certain jurisdictions, you may be responsible for paying local taxes imposed by local tax authorities (such as city taxes or tourist taxes, etc.).
London Bath Property Ltd will notify you of any local taxes that will be payable by you before you complete your booking, where such taxes have been notified to us.

The amount of local taxes can change between the booking date and stay date. If taxes have changed by your stay date, you may be liable to pay taxes at the higher rate.

Payment processing

When payment is taken at the time of your booking and paid for in the local currency of our Service (as relevant), the company taking that payment (via third-party payment processors) and charging your payment method will be clearly identified.

We may collect personal details from you when you visit our Website such as but not limited to your name, address, accommodation details, credit/debit card number and expiry date, billing details and telephone numbers (“Personal Information”) when you use our Website or our online booking service. Your credit/debit card details are only used to process the transaction you have requested and your card details are NOT stored or used in any other way by us.

We may also collect Personal Information directly from you when you speak to us over the telephone or send us correspondence or submit a Guest Review or a review of our accommodation services.

Our Website uses ‘cookies’ (small files saved in your browser) in order to collect information on how you and other internet users use this Website, in order to improve the Website and our services to you. Cookies do not identify you by name but they identify your IP address and allow us to track your visits and usage of this Website.

We may also use Google Analytics and Facebook plugins in order to advertise our services, understand the effectiveness of these adverts and the effectiveness of our Website. Google Analytics collect and store cookies on a server in the USA in order to measure and report on site visits in aggregate. If you do not wish Google to collect cookies about your visits, please review the Google privacy policy and download and install the Google opt-out tool in your browser. If you do not want Facebook to understand that you visited our Website, make sure you are logged out of Facebook when you use our Website.

If you do not want us to use cookies when you visit our Website, you can remove them from your browser, please consult help documentation for your browser. Generally, we use your Personal Information for the sole purpose of delivering our services to you, completing bookings on your behalf, and to ensure that we can efficiently manage and track your booking. The Personal Information we collect is not shared with third parties except where this is necessary to process and complete your bookings or payments, or other transactions on your behalf, to fulfil our contractual obligations to you, or to allow the relevant third parties to fulfil their obligations to you in providing the services that you
requested.

Such third parties may include without limitation:-

• an online booking agency, a bank or a payment processor (for the processing of card payments) (“Booking Partners”).
• of our contracted suppliers (for example any transport company we may use to arrange the relevant transfer, or Eviivo Limited who supply our booking system)
• competent authority that we are legally required to share your Personal Information with (for example police, customs, tax or local health & safety authorities) (“Authorities”) Generally, Booking Partners and Suppliers are either bound by the terms of this Privacy Policy or required to comply with current applicable data protection regulations. Although this Data Protection Policy applies to Personal Information about you that may have been shared with third parties as described above, or provided to us by third parties, we are not responsible for the privacy policies of those third parties, and we will not be liable for those third parties’ data protection policies and practices. You have the right
to request a copy of the Personal Information we hold about you, and you have the right to request that Your Personal Information be rectified, transferred elsewhere, and/or deleted from our systems. You also have the right to withdraw any consent previously given to us with regard to the collection and processing of Your Personal Information. To the extent that We have a legal obligation to hold Your Personal Information – for example the legal requirement to hold invoice information for up to multiple years, and the legal requirement to provide guest registration information to the local Authorities – the minimum information required, including Personal Information, shall be passed to the elevant Authorities and held until the legal requirement expires.
• If You wish to make a complaint about our data protection and privacy policy, including the rights given to you under the General Data Protection Regulations (‘GDPR’), you may contact us by telephone, email, letter. Wherever possible, complaints will be dealt with promptly. Where applicable, if under the terms of this Data Protection Policy, we have passed or need to pass your Personal Information to a third party (Booking Partners, Suppliers, Authorities) for the sole purpose of delivering our services to you, or completing a booking or a payment or some other transaction on your behalf, you may need to direct any complaints and queries on data protection to these third parties also. Eviivo Limited, Booking Com, Air BnB, Holiday lettings, VRBO and Google act as hosts for us.
